Survey of the road haulage cabotage rules in the different EU member states after 1 may 2009

1. What will be the general conditions to carry out road haulage cabotage after 1 May 2009 in your country?

(a) The conditions laid down in Regulation 3118/93 - (yes/no)
(b) The conditions laid down in the new rules - (yes/no)
(c) Other conditions

According to the provisions stipulated at point 6 "Transport Policy" par.(1) annex VII to the Treaty of Accession of Romania and Bulgaria to the European Union, "By way of derogation from Article 1 of Regulation (EEC) No 3118/93 and until the end of the third year following the date of accession, carriers established in Romania shall be excluded from the operation of national road haulage services in the other Member States, and carriers established in the other Member States shall be excluded from the operation of national road haulage services in Romania.

Before the end of the third year following the date of accession, Member States shall notify the Commission whether they will prolong this period for a maximum of two years or whether they will fully apply Article 1 of the Regulation henceforth. In the absence of such notification, Article 1 of the Regulation shall apply. Only carriers established in those Member States in which Article 1 of the Regulation applies may perform national road haulage services in those other Member States in which Article 1 also applies."

Taking into account the above-mentioned, in Romania the conditions for carrying out road haulage cabotage are as follows:

  • Until 01.01.2010 the cabotage is forbidden;
  • In case the Member states will not prolong the above-mentioned period, starting with 01.01.2010, on Romania's territory the provisions of the Regulation (EEC) 3118&93, including the aspects mentioned in art.12 concerning the elimination of all quantitative restrictions (cabotage permits) in carrying out road haulage cabotage on Romania's territory.
  • the provision will also apply until the Regulation concerning the common rules of access to the road transport market of goods will enter into force, regulation that is now on the agenda of the European Parliament and of the Council (Road Package).

2. If the conditions of Regulation 3118/93 will apply, will there be clearly defined limitation to the word "temporary"?

If "yes", please define the limitations:

During the implementation of the provisions stipulated in the Regulation 3118/93, on the Romania's territory will be not temporary conditioning to carry out road haulage cabotage; in case the Romanian transport operators will be subject to conditions imposed by some Member states, Romania will impose, based on reciprocity, temporary conditions to the transport operators from the respective state that is carrying out road haulage cabotage on the Romania's territory.

3. If the conditions of Regulation 3118/93 will apply, will there be a specific control document for road haulage cabotage in your country?

If "yes", please explain what kind of control document, what information it should contain and where it can be obtained:

Implementing the provisions of the Regulation 3118/93, Romania does not intend to introduce a special control document for the road haulage cabotage; the control document for the road transport of goods, for hire or reward, in national traffic is the proof for carrying out road haulage cabotage by a transport operator non-resident - holder of the Community transport authorization according to the EEC Regulation No.881/92 - on Romania's territory.

4. Will the posting of workers Directive 96/71 be actively applied to road haulage cabotage operations in your country?

Implementing the provisions of the Regulation 3118/93, as above-mentioned, Romania will not ask for additional conditions for drivers or transport operators carrying out road haulage cabotage on Romania's territory. Romania reserves the right, by virtue of the equality of treatment stipulated by art.3, par.8 of the Directive 96/71, to impose conditions as mentioned in art.3, par.1 (c) of the Directive 96/71, to the Member states that impose such conditions to the Romanian transport operators on their territory.
