Ref.: request for EC intervention - Republic of Moldova charges abusively high toll rates for foreign vehicles, despite EU-Moldova Association Agreement 

 

Dear Mrs. Bulc,

The National Union of Road Hauliers from Romania – UNTRR, the professional and employers’ association which represents the Romanian companies performing road transport of goods and passengers, kindly asks for your intervention to the Moldavian authorities, asking the Republic of Moldova to harmonize its legislation on the charging of heavy goods vehicles for the use of infrastructures with the European legislation.

In this respect, we would like to inform you that since the beginning of February 2018, several Romanian road hauliers have complaint to our association that the Republic of Moldova charges abusively high toll rates for foreign vehicles, despite EU-Moldova Association Agreement.

According to art. 346 of the Fiscal Code of the Republic of Moldova, the Romanian and foreign road hauliers transiting the Republic of Moldova have to pay:

- a road toll of EUR 15 when entering the territory of the Republic of Moldova.

- moreover, for every 24 hours spent on the territory of the Republic of Moldova or a fraction of 24 hours, the toll rate is EUR 24 on leaving the country.

It results that for the first day of using the road infrastructure in the Republic of Moldova, a foreign haulier has to pay EUR 39 - an unprecedented aspect for the European and international practice.

According to the provisions of the current European legislation - Directive 1999/62/EC, Annex II, "the daily user charge is equal for all vehicle categories and amounts to EUR 12” and "maximum monthly and weekly rates are in proportion to the duration of the use made of the infrastructure", we consider that the Moldavian entering tax of EUR 15 and the toll of EUR 24 per day are exaggerated.

The use of this kind of tax should take into account the general charging principles mentioned in Directive 1999/62/EC of the European Parliament and of the Council of 17 June 1999 on the charging of heavy goods vehicles for the use of certain infrastructures - as subsequently amended and Directive 2011/76/EU of the European Parliament and of the Council of 27 September 2011 amending Directive 1999/62/EC on the charging of heavy goods vehicles for the use of certain infrastructures.

In the light of the above mentioned and taking into consideration the Association Agreement between the European Union and the Republic of Moldova, we kindly ask you to undertake all the necessary measures for the urgent harmonization of the legislation of the Republic of Moldova on the road toll rates with the European legislation, and non-discriminatory enforcement for vehicles and transport operators from other countries.
