Ref. urgent clarification of French procedures to control regular weekly rest & list of safe and secured parking areas in EU Member States available for Romanian trucks during Romanian drivers regular weekly rest outside the vehicle

 

Dear Mrs. Bulc,

 

By this letter, we would like to revert to our previous requests addressed to the European Commission concerning French and Belgian abusive controls of regular weekly rest and also concerning list of safe and secured parking areas in EU Member States.

 

  1. UNTRR request for EC immediate intervention to stop French and Belgian abusive controls of regular weekly rest (UNTRR letter no.1142/09.05.2018)

Thank you for your reply letter Ref. Ares(2018)3114198 - 13/06/2018 regarding controls of weekly rest in France and Belgium, mentioning that Belgium and France confirmed to the European Commission that “enforcement authorities cannot require any proofs, such as hotel bills from drivers, proving that their regular weekly rest preceding the roadside inspection was not spent in the vehicle”. Despite this, may we draw your attention on the different reply of the French Ministry of Transport to French association – AFTRI, stating that the French control officers are authorized:

- to sanction offenses related to regular weekly rest in the vehicle even if the offense was committed in the territory of another Member State

- impose a sanction for offences of regular weekly rest preceding the roadside inspection, established by any other means of proof. Please find annexed hereby the reply of French Ministry to AFTRI.

We kindly ask the European Commission to undertake the necessary measures for the urgent clarification of French procedures to control regular weekly rest and to stop the French abusive controls against Romanian road hauliers.

 

  1. UNTRR request for the list of safe and secured parking areas in EU Member States available for Romanian trucks during Romanian drivers regular weekly rest outside the vehicle (UNTRR letter No.1068/06.06.2017)

In your reply Ref. Ares(2017)3551694 - 13/07/2017, the EC was mentioning that it “does not possess such a list and would refer UNTRR to contact the relevant national authorities for such information”. We would like to inform you that last year, UNTRR has also addressed French, Belgian and German authorities with this request, but we have not received any answer until now. Consequently, this year UNTRR reverted to French, Belgian and German authorities with the same request to send us the list of safe and secured parking areas available in their countries for foreign (Romanian) trucks allowing foreign(Romanian) drivers to spend the regular weekly rest outside the vehicle – as an accompanying measure to their national laws banning regular weekly rest in the truck. May we also revert to the European Commission with the kind request to support us in obtaining these lists of safe and secured parking areas available in Belgium, France and Germany. As the EC Mobility Package also proposes to ban the regular weekly rest in the cabin, we consider that national lists with sufficient safe and secure parking areas across the EU should become a compulsory requirement for each Member State, before introducing this ban – as a measure guaranteeing that EU rules are applicable and not raising impossible barriers for European road transport industry.
